Oregon Supreme Court asks for review of protective order over Synod documents
The Oregon Supreme Court has directed Multnomah County Circuit Court to either vacate the protective order granted over Lutheran Church—Missouri Synod documents or “show cause” why the Supreme Court should not vacate the order.
Plaintiff Hotchalk, Inc., petitioned the Supreme Court in September to issue the alternative writ of mandamus after the trial court granted the Synod’s motion for protective order over roughly 2,000 documents which Synod attorneys had argued were confidential and protected from discovery under the First Amendment.
A trial in the $302 million lawsuit is scheduled for January 2024.
